The Consequences Of Aggravated Assault And Battery

In Georgia, assault and battery can be charged as misdemeanors or felonies, depending on the circumstances. Even if you don’t physically injure someone, brandishing a weapon, or creating the fear of physical injury is enough to charge you with assault.

Simple assault and battery are misdemeanors and punishable by up to $1,000 in fines and up to one year in prison. However, if the alleged crime involved certain “aggravating circumstances,” such as an elderly or pregnant victim, a police officer or a domestic situation, fines may be increased to $5,000.

Aggravated assault and battery are felony-level offenses. If found guilty, you face large fines into the hundreds of thousands of dollars and up to 20 years in prison. Even after serving your time, a felony conviction will remain on your permanent record, making it difficult to find employment or housing. In addition, convicted felons are stripped of their right to vote and carry a gun.
