Temporary Restraining Orders: A One-Sided Story With Criminal Consequences

In Georgia, a person can get a temporary restraining order (TRO) against you without a hearing and without giving you a chance to tell your side of the story. This means you can be ordered out of your house and be required to cut all contact with your accuser based on his or her claims alone.

Within 30 days, a hearing will be held to determine whether the TRO will become more permanent, placing restrictions on you for up to one year. These hearings are akin to mini-trials. Your accuser may take the stand, and bring evidence and witnesses to support his or her case. It is important to have an experienced criminal defense attorney protecting your rights.
